روز 19 نوامبر، سناتور جان کایل از آریزونا که از بانفوذترین سناتورهای آمریکاست، نامه ای به اریک هولدر وزیر دادگستری آمریکا نوشت و رسما از او خواست که در مورد لابیگری نایاک تحقیق کند. طبق قانون، وزیر دادگستری بایستی هرچه زودتر به نامه سناتور کایل پاسخ داده و در اینمورد اقدام نماید.

"روز 13 نوامبر، روزنامه واشنگتن تایمز گزارشی تحت عنوان "یک گروه ایرانی احتمالا قوانین لابی را نقض کرده است" به چاپ رساند و در آن مدعی شده است که شورای ملی آمریکائیان ایرانی تبار (نایاک) بطور غیر قانونی مشغول لابی است و چه بسا قوانین مالیانی، قانون ثبت نمایندگان دولتهای خارجی و همچنین قانون گزارش در مورد لابیگری را زیر پا گذاشته است.
آیا وزارت دادگستری در مورد مطالبی که در این مقاله ذکر شده تحقیقاتی را شروع کرده است؟
آیا نتیجه این تحقیقات با اظهارات روزنامه واشنگتن تایمز مطابقت دارد؟

Kyl presses for NIAC inquiry
Arizona Sen. Jon Kyl, a Republican source says, sent written questions to Attorney General Eric Holder following yesterday's meeting, going after the National Iranian American Council, a group drawing conservative ire because it advocates a soft(er) line on Iran and the subject of a Washington Times piece raising questions about its lobbying status.
Senator Kyl's questions:
The November 13, 2009 Washington Times article, “Iran advocacy group said to skirt lobby rules” alleges that the National Iranian American Council (NIAC) may be operating as an undeclared lobby and may be guilty of violating tax laws, the Foreign Agents Registration Act, and lobbying disclosure laws.

• Has Department Of Justice found the allegations in this article to be true?
• What is the proper recourse against a 501(c)(3) group that engages in lobbying activity on behalf of a foreign government without registering as a lobbyist or filing papers with Department Of Justice indicating that the group is a local agent of a foreign government?
